What is Rape

Punishment in Rape

The BNS imposes harsher penalties for aggravated factors and vulnerable victims:

Rape of a woman under twelve (Section 65(2)) carries a minimum of twenty years of rigorous imprisonment, which may extend to life imprisonment or the death penalty, and a fine.

Gang rape (Section 70(1)) is punishable by a minimum of twenty years of rigorous imprisonment, potentially extending to life imprisonment, and a fine.

Gang rape of a woman under eighteen (Section 70(2)) results in imprisonment for the remainder of natural life or the death penalty, and a fine.

Causing death or a persistent vegetative state (Section 66) is punishable by a minimum of twenty years of rigorous imprisonment, potentially extending to life imprisonment or the death penalty.

Repeat offenders (Section 71) face imprisonment for the remainder of their natural life or the death penalty if they re-offend after a previous conviction for a serious sexual offence.

Individuals in positions of authority, such as police or public servants, who commit rape face enhanced punishments ranging from ten years to life imprisonment.
